Terms of Service

Learn about the terms and conditions governing your use of EVANI Travel's website, travel packages, bookings, cancellations, refunds, and related travel services in Georgia.

1. Introduction & General Terms

Welcome to EVANI Travel.

These Terms of Service govern your access to and use of the EVANI Travel website (www.evanitravel.com), as well as travel-related services booked or arranged through EVANI Travel.

EVANI Travel is a travel company based in Tbilisi, Georgia, offering travel packages, accommodation arrangements, private tours, transfers, travel insurance assistance, visa-related assistance, and other travel services.

These Terms apply to individual customers (B2C) and travel agents or business partners (B2B), as applicable to their respective bookings and contractual relationships.

By accessing our website or requesting or confirming a booking with EVANI Travel, you acknowledge these Terms of Service. Any specific conditions communicated in a confirmed booking or separately agreed contract will also apply.

Please read these Terms carefully before using our services. For general inquiries, contact us at info@evanitravel.com. For booking assistance, cancellations, refunds, or customer support, please email support@evanitravel.com.

2. Booking & Payment Terms

Booking Requests

Customers and travel agents may request travel packages, accommodation, transportation, tours, and other travel services through EVANI Travel’s website or authorized communication channels.

Submitting a booking request does not automatically constitute a confirmed reservation. Bookings are subject to availability and confirmation by EVANI Travel and, where applicable, the relevant service providers.

Booking Confirmation

A booking is considered confirmed once EVANI Travel has issued written confirmation specifying the agreed travel arrangements and applicable booking conditions.

Customers and travel agents are responsible for reviewing the booking confirmation and promptly notifying EVANI Travel of any discrepancies.

Pricing and Payments

Prices are provided according to the requested services, travel dates, number of travelers, accommodation arrangements, and other booking requirements.

The total package price, payment schedule, accepted payment methods, and any applicable charges will be communicated during the booking process.

Payment requirements may vary according to the selected services and the terms agreed upon in the booking confirmation or applicable B2B agreement.

Accurate Traveler Information

Customers and travel agents must provide accurate and complete traveler information, including names, contact details, travel dates, and any additional information reasonably required to arrange the requested services.

Traveler names and passport details must match the relevant official travel documents when required for reservations, transportation, visa applications, or other travel arrangements.

Third-Party Travel Services

Certain travel arrangements may be provided by independent hotels, airlines, transportation companies, insurers, or other suppliers.

Supplier-specific conditions may apply to these services and will be communicated where relevant to the booking.

3. Cancellation & Refund Policy

General Cancellation Conditions

This Cancellation & Refund Policy applies to travel packages booked with EVANI Travel by direct customers (B2C) and travel agents (B2B).

Cancellation charges are calculated based on the total confirmed package cost and the time remaining before the scheduled arrival in Georgia.

Cancellation More Than 96 Hours Before Arrival

Cancellations received more than ninety-six (96) hours before the scheduled arrival time are generally free of cancellation charges.

However, where specific travel arrangements involve non-refundable deposits or non-recoverable third-party supplier costs, such amounts may be deducted from the refund, provided that these conditions were clearly disclosed to and accepted by the customer before booking confirmation.

Any deduction shall be limited to reasonable, documented and genuinely non-recoverable costs, subject to applicable consumer protection laws and any mandatory rights of the customer.

Cancellation Between 96 and 24 Hours Before Arrival

Cancellations received between ninety-six (96) and twenty-four (24) hours before the scheduled arrival time, inclusive, may be subject to a cancellation fee of up to 50% of the total confirmed package cost.

The applicable charge will be assessed in accordance with the confirmed booking conditions and the provisions under “Application of Standard Cancellation Charges” below.

Cancellation Less Than 24 Hours Before Arrival

Cancellations received less than twenty-four (24) hours before the scheduled arrival time may be subject to a cancellation fee of up to 70% of the total confirmed package cost.

The applicable charge will be assessed in accordance with the confirmed booking conditions and the provisions under “Application of Standard Cancellation Charges” below.

Cancellation After Arrival in Georgia

Cancellations made after the traveler’s arrival in Georgia may be subject to cancellation charges of up to 100% of the total confirmed package cost, depending on the services already provided, non-recoverable supplier commitments, and the applicable booking conditions.

Where any services remain unused or can be cancelled without cost, EVANI Travel will assess whether an appropriate refund or reduction of cancellation charges is due, subject to applicable law.

No cancellation charge shall exclude or restrict any mandatory refund rights or remedies available to the customer under applicable consumer protection law.

Application of Standard Cancellation Charges

The cancellation percentages stated above represent EVANI Travel’s standard cancellation fee schedule and are not intended to operate as automatic penalties.

The application of these charges is subject to the confirmed booking conditions, the services already performed, reasonable and demonstrable costs or losses associated with the cancellation, and any mandatory legal rights of the customer.

Where required by applicable law, EVANI Travel will review the applicable cancellation charge and provide a reasonable explanation of its calculation.

Any non-refundable third-party supplier costs already deducted under this Section shall not be charged again as part of another cancellation fee.

Where applicable law requires a lower charge, a reduction, or a refund without cancellation fees, the mandatory legal requirements shall prevail.

Refund Processing

Where a cancellation qualifies for a refund, EVANI Travel will calculate the refundable amount after deducting any applicable, reasonable, and legally permissible cancellation charges.

Refund requests will be reviewed and processed without undue delay, taking into account the applicable booking conditions and any mandatory legal requirements.

Where applicable law establishes a specific refund deadline, including a shorter mandatory period, that deadline shall take precedence over any administrative processing timeframe.

For refunds not subject to a specific mandatory statutory deadline, EVANI Travel aims to complete the refund process within fourteen (14) business days after confirming the customer’s entitlement and the refundable amount.

Any additional processing time required by banks, card issuers, payment providers, or third-party suppliers will be communicated to the customer where reasonably possible.

Nothing in this provision limits any mandatory refund rights available to customers under applicable law.

Cancellation Requests

Cancellation requests must be submitted in writing to support@evanitravel.com, including the booking reference, traveler name, and scheduled arrival date.

The time at which EVANI Travel receives the written cancellation request will be used to determine the applicable cancellation period.

Calculation of Cancellation Periods

Cancellation periods are calculated using the scheduled arrival date and time specified in the confirmed booking, based on Georgia local time.

The applicable cancellation fee is determined by the date and time EVANI Travel receives the written cancellation request through its designated customer support channel.

For clarity, a cancellation received exactly 96 hours or exactly 24 hours before the scheduled arrival time falls within the 50% cancellation fee period.

Any mandatory cancellation or refund rights provided by applicable law shall take precedence over these standard cancellation charges.

4. Travel Documents, Visa & Entry Requirements

Passport and Travel Documents

Travelers are responsible for ensuring that their passports and travel documents are valid and meet the entry requirements of Georgia and any transit countries.

Passport validity requirements may vary depending on the traveler’s nationality, itinerary, and applicable immigration regulations.

Visa and Entry Requirements

Visa requirements for Georgia depend on the traveler’s nationality, residency status, travel purpose, and other applicable conditions.

Travelers must verify the relevant visa and entry requirements before departure and obtain any required visas or travel authorizations.

Georgia E-Visa Assistance

EVANI Travel may provide administrative assistance with Georgia e-Visa applications, including guidance on required documents and application procedures.

EVANI Travel provides administrative visa assistance only and does not issue visas or guarantee visa approval, entry permission, or admission into Georgia.

Visa processing delays, visa refusals, or border entry denials by competent authorities do not automatically entitle the customer to a full refund of separately booked travel services.

Any cancellation or refund relating to affected travel arrangements will be assessed in accordance with Section 3, the applicable booking conditions, and mandatory consumer protection laws.

Nothing in this provision excludes liability arising from EVANI Travel’s own negligence, misrepresentation, or failure to perform its contractual obligations.

Immigration and Border Control

Possession of a valid visa or other travel authorization does not guarantee entry into Georgia.

Final admission decisions are made by the competent border and immigration authorities in accordance with applicable laws and regulations.

Accuracy of Submitted Information

Travelers and travel agents must ensure that all personal information, passport details, and supporting documents submitted for travel arrangements or visa assistance are accurate, complete, and authentic.

Incorrect or incomplete information may result in delays, additional costs, visa refusal, or travel disruptions.

Changes to Entry Requirements

Immigration, visa, and entry requirements may change without prior notice.

Travelers are encouraged to verify the latest official requirements before departure and to contact EVANI Travel if assistance is needed in understanding the applicable procedures.

5. Travel Services, Suppliers & Responsibilities

Scope of Travel Services

EVANI Travel arranges and coordinates travel-related services in Georgia, including holiday packages, accommodation, private tours, transportation, airport transfers, and other services specified in the booking confirmation.

The services included in each booking are determined by the agreed itinerary, quotation, booking confirmation, or applicable contractual agreement.

Third-Party Service Providers

Certain services may be delivered by independent hotels, airlines, transportation providers, tour operators, insurance companies, and other suppliers.

These providers may have their own operational policies, safety requirements, and service conditions.

EVANI Travel will communicate relevant supplier conditions where applicable and will assist customers in addressing service-related concerns within the scope of its responsibilities.

Responsibility for Package Travel Services

Where EVANI Travel acts as the organizer of a package travel contract, it shall remain responsible for the proper performance of the travel services included in that contract to the extent required by applicable law, including where individual services are delivered by independent suppliers.

Where EVANI Travel acts solely as an intermediary for an independently booked service, its responsibilities will be determined by the confirmed booking arrangements, its contractual role, and applicable law.

The involvement of third-party suppliers does not automatically exclude EVANI Travel’s contractual or statutory responsibilities.

Changes to Travel Arrangements

Travel arrangements may occasionally require adjustments due to weather conditions, road closures, operational restrictions, supplier availability, or other circumstances affecting the delivery of services.

Where reasonably possible, EVANI Travel will inform the customer or contracting travel agent of material changes and discuss available alternatives.

Any additional charges or refunds arising from such changes will be assessed according to the confirmed booking terms, applicable supplier conditions, and relevant legal requirements.

Customer and Traveler Responsibilities

Travelers are expected to follow reasonable safety instructions, respect local laws and regulations, arrive at designated meeting points on time, and provide accurate information necessary for their travel arrangements.

Customers and travel agents should promptly inform EVANI Travel of any service concerns so that appropriate assistance can be provided.

Travel Agent Responsibilities (B2B)

Travel agents booking through EVANI Travel are responsible for accurately communicating confirmed itineraries, service inclusions, payment conditions, cancellation terms, and relevant travel requirements to their customers.

Any additional responsibilities established in a separate written B2B agreement will apply in accordance with that agreement and applicable law.

Service Concerns and Assistance

EVANI Travel aims to provide timely assistance when customers experience issues with services arranged through the company.

Customers and travel agents may report booking-related concerns to support@evanitravel.com, including their booking reference and a description of the issue.

Nothing in these Terms is intended to exclude or restrict any rights or responsibilities that cannot lawfully be excluded under applicable law.

Reproduction, commercial redistribution, or unauthorized use of protected website materials requires prior written permission from the relevant rights holder, except where permitted by applicable law.

Third-Party Websites and Links

The EVANI Travel website may contain links to external websites operated by hotels, airlines, payment service providers, government authorities, or other third parties.

These websites may have their own terms of use and privacy policies. EVANI Travel does not control their content or independent data-processing practices.

7. Liability, Force Majeure & General Provisions

Responsibility for Travel Services

EVANI Travel is responsible for performing its contractual obligations with reasonable care and diligence, in accordance with the confirmed booking arrangements and applicable law.

Where travel services are provided by independent suppliers, EVANI Travel will assist customers and travel agents in addressing service-related issues within the scope of its contractual and legal responsibilities.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Limitations of Liability

EVANI Travel shall not be responsible for losses or disruptions arising solely from circumstances outside its reasonable control, except where responsibility is imposed by applicable law or the terms of the confirmed booking.

Any limitation of liability shall be interpreted in accordance with applicable Georgian law and shall not restrict mandatory consumer protections or other rights that cannot lawfully be excluded.

Force Majeure and Extraordinary Circumstances

Events beyond the reasonable control of the parties may affect travel arrangements. Such events may include natural disasters, severe weather, government restrictions, civil unrest, public health emergencies, transportation disruptions, or other extraordinary circumstances.

Where such events materially affect the provision of confirmed services, EVANI Travel will make reasonable efforts to inform affected customers or travel agents and discuss available alternatives.

Any cancellation charges, refunds, rescheduling arrangements, or additional costs arising from these circumstances will be determined according to applicable law, the confirmed booking terms, and relevant supplier conditions.

Mandatory Rights in Extraordinary Circumstances

Where unavoidable and extraordinary circumstances significantly affect the performance of a package travel contract or the transportation of travelers to the destination, customers may be entitled to terminate their booking without paying the standard cancellation charges, where required by applicable law.

In such cases, any refund or alternative arrangement will be determined in accordance with the applicable legal requirements and the confirmed contractual arrangements.

Nothing in this Cancellation & Refund Policy or these Terms of Service is intended to restrict mandatory consumer rights or remedies available under applicable law.

Amendments to These Terms

EVANI Travel may update these Terms of Service to reflect changes in its services, operational procedures, or applicable legal requirements.

The updated Terms will be published on the website with an appropriate effective date. Changes will not retrospectively alter confirmed contractual rights or obligations unless lawfully agreed or otherwise permitted by applicable law.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Georgia, subject to any mandatory consumer protection provisions and jurisdictional rules applicable to the relevant contractual relationship.

For business-to-business (B2B) relationships, the parties may agree that disputes arising from these Terms shall be submitted to the competent courts of Tbilisi, Georgia, to the extent permitted by applicable law and any valid jurisdiction agreement.

For individual consumers (B2C), nothing in these Terms limits any mandatory right to bring proceedings before a competent court or seek remedies available under applicable law.

The parties are encouraged to seek an amicable resolution of disputes by contacting EVANI Travel before initiating formal proceedings. Nothing in this provision makes informal resolution a mandatory precondition to exercising any legal right.
